Will a divorce on stamp paper be valid

my brother got married to a girl last year who was divorcee through panchayat/notary. she has a notarized stamp paper as a proof of divorce. now my brother does not want to stay with her, and they are asking for money for giving divorce. Can he get the marriage null and void through the court since her previous divorce was through panchayat only and court does not recognize that ? how can he get rid of her without paying her anything. Girls family has gone to women cell and they are harrassing us.

Well in that case the previous marriage was also not dissolved and the second marriage is alsoNull and void.You might take a stand before the investigation agency or in the court that you are not apprised by the girl about the previous marriage and legally she is not divorced person.

There is no validity of divorces on the stamp paper unless a decree to the effect is obtained through the court of competent jurisdiction with valid means. A person whose spouse is harassing can also approach the court and get relief

There exists no valid divorce between the woman from her previous husband, decree of court dissolving the marriage is only valid under the Hindu Marriage Act,1955 for Hindu marriages and hence the second marriage the woman did was null and void. No need for any decree of nullity from the Family Court required for marrying again, however that can always be got by moving petition for nullity under section 11 of the Hindu Marriage Act,1955 for Hindu parties and Hindu marriage.

Such type of divorce is not valid in law. What is your caste? your brother has to file a proper divorce suit.
How can women cell trouble you? You go and lodge complaint against her.Hire an advocate and he can only help you.
