Wife'e Ex-parte order came recall filed by other party

In maintenance case wife's permanent maintenance order came 1st Nov 2025. 2 kids,5-10 yrs old children.Now wife filed for recovery warrant.Other party came and filed recall now on 12th Dec 2025.What happens.When he will start giving.How much time recall takes.We will file objection on 20th Feb.

after 1 February 2026 you can file a execution petition of against order of 1st November 2025. before filed objection in recall application and demand to arrear fund of said order after that filled objection in recall application. for more information you can contact us.

Once permanent maintenance order is passed (1st Nov 2025), the husband is legally bound to pay from that date, irrespective of any later application. Effect of recovery warrant & recall application: Recovery warrant filing: Since he did not comply, filing a recovery/execution is correct. The court can issue warrant for recovery, attachment of salary/property, or civil imprisonment for wilful default. Recall application (filed on 12 Dec 2025): A recall application does not automatically stay the maintenance order. Unless the court specifically grants a stay, the husband must continue paying maintenance and clear arrears.
