Wife working and taking maintenance.

I am paying 7000 rs maintenance on a monthly basis for my wife and child. But now got to know my wife working in a private school as a teacher and she is getting salary cash in Hand. Is it a good idea to collect evidence and show it in family or high court as in most of the cases court hardly change maintenance amount Once its fixed.

You can always file an application for modification/cancellation of maintenance before the court alleging that she's working right now and annexure any evidence you are having before the court. Yes you need to file an appreciate application for alteration of interim maintenance under section 127 of the Criminal Procedure Code before the family court where the matter is subjudice and satisfy the court by leading evidence as to change in circumstances of your spouse. Yes, you can approach the court for alteration in the order by stating the above said income of the wife. Also, if she hid this from the court you can also put this before court. Yes you are right that the court barely changes the order once made but if there is sufficient reason for the change, the court cannot deny it.

no if she is working no need to pay complete amount but u should have proof regarding ur wife that she is working as a teacher if u have proof then no need to pay ur wife alimony only u will give to ur child u will be entitled only for child then 2nd thing is this don't pay amount in cash pay through bank u should have proof pr month amount

Yes u can file 340 application where u can change the order of Mao by collecting papers remember u r bound to pay maintenance for the child fir further details and information plz free to call Try to settle the case by agreement
