Wife Staying Separately Out of Her Own Will

17-Oct-2023 (In Divorce Law)
We got married in 2015, after which I moved to the US. Our differences began soon after, root cause being her dislike for my parents (no dowry angle involved, just downright dislike). The differences were dire enough to not let our marriage consummate for 3 years (which I'm sure she wouldn't admit in the court of law). Last year in October, she called up the police after an altercation and got me arrested for domestic violence (it was a false complaint, I came out clean in local court). However, after she the filed complaint, she moved out of home of her own volition, and is living alone for an year. Neither has she sent out any feelers for reconciliation, nor am I keen after her colossal trust-killing step of involving the police. She doesn't look keen on mutually agreed separation. What are my options?

Dear queriest, as per your query you have mentioned about certain facts which had ruined your martial life, here your option is to send her a legal notice regarding whatever happened till date to remind her and ask her for mutual consent divorce or else you will go for litigation and may take exparte decree and get free from this relationship.

whatever instances you have mentioned in your query clearly suggests that your wife may not give you divorce easily. But you may file for contested divorce on the ground of cruetly as it seems that she has treated you with cruelty. Dislike for your parents and filing criminal case against you amounts to cruelty and the other reason could be non- consumation of marriage as well.
