Wife sent legal divorce notice but i dont want to give divorce
28-Mar-2023 (In Divorce Law)
Dear sir/madam, according to hindu tradition I got married in 2018 and spouse got pregnant in may 2019. Suddenly in jun 2019, my wife ran away with in-laws while I was in office. No information to me via call, sms, whatsApp was given of her leaving place without any mutual consent or reason. Since last 3 years we are living separate. We send them notice for section 9(RCR), so in turn WIFE Lodged false FIR Against me, my parents. She needs divorce with mutual consent but i denied. Now she sent a notice from kota family court mentioning grounds and date of presence mentioned by court. If I don't get present, court will issue decree to wife.
My parents are 60+ old and need someone to take care during worktime. I don't want to give divorce but I can give divorce if false case against me and my parents are withdrawn off. Please advice me. Thanks
see, if she is asking for divorce on false allegations, then should divorce her, because what if she again hurt you or your family members, and you should attend the court because if you will not attend then you will automatically become suspected, and you will loose one chance to prove her wrong, you should fight to prove you and your parents right, with correct guidance and facts provided by you, you will definitely have a chance to win over her
1. you hv to appear in divorce case and file ur reply. once u appear, u cn also request fr mediation at Family court for reaching a settlement. if such settlement is reached, u cn agree fr mutual consent divorce if ur wife withdraws cases against ur family.
2. you cn file for transfer of case from Kota to ur city on grounds of old parents.
3.you hv to attend the proceedings in relation to FIR loded by your wife.
