wife refusing to return unless he leaves his mother

24-Mar-2026 (In Divorce Law)
Seeking legal advice for my elder brother. His wife went to her parental home in Bardhaman during pregnancy, delivered on 12 Oct 2025, and has not returned since. She refuses to come back unless he lives separately from his mother. They last lived together in Meerut (UP), which is also their permanent address. What legal action should he take (RCR/divorce), how to protect from 498A/DV, and which court is best – Meerut or Bardhaman?

Your brother has both legal and strategic options here, and the approach should be balanced rather than rushed. First, on the wife staying at her parental home and refusing to return unless he separates from his mother — courts have consistently held that a wife cannot be forced to live in a joint family against her will. So this demand alone may not amount to cruelty. If your brother genuinely wants to continue the marriage, he can file a petition for restitution of conjugal rights under Section 9 Hindu Marriage Act in Meerut, since that is their last matrimonial home. This shows his bona fide intention to resume cohabitation and also creates a legal record in his favour. If reconciliation is not possible, he may consider filing divorce on appropriate grounds like cruelty or desertion, but desertion requires a continuous period (generally 2 years), so timing is important. Regarding protection from Section 498A IPC and Domestic Violence cases: * Maintain respectful communication and avoid any threatening messages * Keep records of conversations showing willingness to bring her back * Avoid unnecessary confrontation with her or her family * In case of FIR, immediately seek anticipatory bail On jurisdiction, he can file RCR/divorce in Meerut. However, the wife has the advantage to file cases like maintenance or DV at the place where she is currently residing, i.e., Bardhaman. Also, since a child is born, he should be prepared for maintenance claims under Section 125 CrPC for both wife and child. A practical approach would be: * First send a legal notice requesting her to return * Then file RCR in Meerut * Simultaneously prepare for any 498A/DV proceedings This keeps him legally protected while leaving scope for settlement.

aap RCR file kar sakte hai iske baad mother ki taraf se DV act ka case file kar sakte hai baki agar woh 498 ka case karti hai toh high court se stay le sakte hai ya fir mediation b ek best way hai aur agar woh alag hone k liye bol rhi hai toh divorce b file kar sakte hai and for more details you can contact me.
