Wife not willing to give divorce, what to do ?
04-Dec-2023 (In Divorce Law)
Hello, i am a Hindu Brahman guy. I have filed a Divorce case 2 years back. after that my wife logged 2 complaint i.e. at CAW Cell and another one of Domestic Violence. Both the cases are in process. After 1.5 years, I have started giving her 10,000/- on month basis as a maintenance charges. she is not willing to give divorce. Please help me to understand few facts. 1. Is this situation will remain same till the time she didn't agree? 2. Is there any law which i can peruse for further action in my favor. 3. Can i marry again (if there is any option)? Request you to please help! Thank You

You need to mention the grounds of divorce here and under what section you have filed divorce. There are many solutions to this condition. However clarity is expected from your side so that actual line can be taken up for better and fast solution. Don't remarry till the decision that will attract police action.
If you are living alone from that year when you filed divorce case then you can give an application for living with her.Because she will not agree for living with you.
if you have proof of bad character of your wife then you can take a legal action against her
if these complaints had been filed after filing your case then you can rescue

I need to know more facts on your case. You cannot remarry till the time you are not officially divorced. Your separation time and facts of the case you have filed for divorce needs to be considered to guide you further. No court can force you to live together.
The cases pending will remain in progress and u can file divorce petition u/sec-13A of Hindu marriage act 1955 but u can't marry till your divorce will be final Except this u can file quashing petition u/sec-482cr.p.c.in the Hon'ble high court of your state
