Wife not living in india, how can we file for divorce?

Me and my wife are separated from 2 years and meanwhile she went dubai for work. Whenever I ask her about divorce, she tells me that she is on a contract job where it will take 3 years to come india. I can't wait for this long time as she dnt show any interest in completing the paperwork and I even don't know if she will come back or not.

You file for divorce in the Family Court in whose jurisdiction you both had last resided together and the court will issue notice to her to be served through the Indian consulate in Dubai. However you have not mentioned your and your spouse religion, your place of marriage, place where you both lastly resided together, children out of this wedlock, whether the marriage was solemnised under Hindu law or Muslim law or under special marriage act and any cases pending against each other.

dear client, if you had the working or residentail address of your spouse in dubai then you would file a case of divorce in the grounds that will make up from the facts of your case so file a case of divorce under sec 13of hindu marriage act and proceed with that

You can file divorce petition here and she can be served at Dubai through court. She can give her consent for divorce. Or If she is also ready for divorce, joint petition can be filed and her statement could be recorded by video conferencing.

For a marriage which is solemnized under hindu marriage act shall also be separated under hindu marriage act only. In that case you shall file a divorce petition on the grounds of desertion at your nearest family court which falls under your jurisdiction and get the summons served upon the wife at Dubai. No matter where is she, she has to come to the court where the marriage is actually solemnized.
