Your matter involves property rights, child custody/visitation, the 498A case, and possible DV proceedings. Whether you can file an injunction suit, partition suit, custody case, or seek other relief depends on the property documents and case records. Please meet a family and civil law advocate with all relevant documents for detailed legal advice before taking any action.

You may certainly protect your legal rights. If the property stands in the joint names of both spouses, one co-owner cannot exclusively deal with or appropriate the property to the exclusion of the other. Subject to the title documents and facts, you may explore appropriate civil remedies including injunction, partition, rendition of accounts and recovery of your lawful share of rental income. As regards the child, unilateral decisions concerning schooling and welfare may be relevant in appropriate custody/guardianship proceedings. Simultaneously, you should contest the 498A case strictly on its own merits and be prepared for any proceedings under the DV Act. Avoid making allegations regarding any alleged relationship unless supported by legally admissible evidence. Preserve all documents, rental records, bank statements and communications. A comprehensive review of the property documents and pending litigation is necessary before deciding the most effective legal strategy.

If the property stands jointly in both names, one co-owner cannot ordinarily exclude the other from his legal rights in the property. Depending on the nature of ownership and facts, you may explore appropriate civil remedies including partition and, if necessary, injunctions to protect your interests. As regards the child, courts primarily consider the welfare of the child, and changing schools without your consent may be a relevant factor but does not automatically make the action illegal. The 498A proceedings, any proposed DV case, property disputes, custody issues, and matrimonial disputes are separate proceedings and should be dealt with independently. Mere suspicion or allegations regarding a third person are not sufficient; legally admissible evidence is required if you intend to rely upon such facts.
