With the limited facts provided, it can be said that you wants to end the marriage as you have been harassed and tortured by your wife previously. We can file for divorce on the ground of cruelty against her. For any further advice feel free to contact Thanks

From the subject of your query, I infer that you are seeking divorce on grounds of cruelty and desertion. In such a circumstance, you can file for divorce on grounds as mentioned above. You need to separately file an application before the appropriate Court seeking directions to your spouse for visitation rights with the child.

You may file an application seeking custody or visitation in a Divorce matter and get the entire mess over with. The entire process is time consuming and can be done by two ways i.e either by mutual consent or by contested form. The way you choose is based upon your understanding

In this situation, you may file a divorce petition on the ground of desertion with an interlocutory application seeking visitation rights to meet your child on a regular basis. Moreover, depending upon the merits of your case, you may separately file a guardianship petition seeking custody of your child as well. You may consult me in that regard.
