Wife is abusive how can I file for divorce

A Hindu Boy ,I got married in 2009. I had good relations with my maternal uncle and aunty living in neighborhood. I told my wife that I had crush on maternal aunty. She was from conservative family and took it for affair. She barred entry of them in house along with mausis and children. My mother did not object to save my home but remain in tension. Wife started to curse and abuse my parents.Mother caught a disease and died in 2015. But wife kept accusing me of affair with MAMI and leave home every then and now after fighting on petty issues. I want divorce. I have a child of 5 years.

For filing divorce you need to show some valid reason before the court of law. You can file divorce on the ground of cruelity but the wuestion is what cruelity and for this you have to discuss your entire married life incidences with us. There after we can go for a divorce

you can file divorce for the cruelties done by her under section 13 of Hindu marriage act
however you have to twist some facts
don't woory , we will ensure that you succeed in the matter

It was not necessary to prove adultery, or any other serious charge of marital malpractice, in order for husband and wife to terminate their union if you both persons are agree to file by mutual consent.
In such a case, as the husband wishes to divorce, he will have to file separately petition to the court to grant the divorce. Such a petition can be made by the husband only on certain grounds, listed below.
1.The court will call upon the husband to prove the ground sought by him for the divorce.
2.Tthe wife will be called to disprove the allegations. If the husband's allegations are proved, the court would award a divorce, even if the wife does not wish to divorce.

Adultery
Cruelty
Desertion
Conversion
Unsoundness of mind
Schizophrenia
Virulent and incurable leprosy
Entering new religious order
Presumption of death

Yes you can file suite for divorce before the family court against your wife on the ground of cruelty the court after recoding evidences on both the sides will pronouncr the judgement in your case as per your query you are being alleged for false case and for that your mother also died hence you can take the plea for crurlty further you can contact for futhetrv enquiry and for filing the petition
