Wife involved in many fraud case and 420,467,468 imposed on her

Hi experts, Seeking your advice on below points 1).can court grant maintenance to wife against husband if she is involved in criminal activities like doing frauds with many people due to which police kept her in prison for 30+ days before she got bail because of pregnancy. husband is not aware of her fraud case until police arrested her. 2).if wife is pregnant and husband has doubt on pregnancy,can he ask for DNA.what will be consequences if he do so?

Yes u can challenge that in the court on grounds that ur wife has a tainted and criminal background and has committed fraud (if financially) giving evidence of those and also she kept u in dark and has committed fraud even against her husband and therefore not entitled for any msintenance. On the second issue u can approach the high court if u have any suspicion regarding that and that she has not conceived the child from u as u must be knowing a tentative date when u had cohabitation with her and ask the high court to give direction for conducting a DNA Test as also there is a case relating to conducting of DNA Test for ascertaining the parentage in Bhabani Prasad Jena Etc vs Convenr Sec Orissa (2010)in which orissa high court had allowed the conducting of DNA Test. You can seek judicial separation and apply for divorce as she is involved in criminal activities and this is a cruelty on you. you can also request the court for DNA test if you think the child is not yours. maintenance will be granted to her only if she applies else no.
