Wife implicated my parents in false DV Case but they dont live with me

10-Feb-2023 (In Divorce Law)
Hi I filed for divorce as my wife had asked me multiple to cut of relations with my parents as well as my sisters (all of whom stay abroad and have never stayed with me and my wife). After this, my wife filed 498a as well as Domestic Violence 2005 case against me, my parents and my sisters. In both cases she has named all of them as well. Can I go for quashing this case against my parents and my sisters? I know that I will not be able to do tat in 498A but in DV case, I heard there needs to be a domestic relationship established.

yes you go for quashing but mostly cases high court not quashing 498A FIR but if you go high court for quashing so there are some chances to cut names of your sister or parents. and in Domestic violance cases no need to come in court your advocate apper in court behalf of you and other accused or respondent

Hello you can go for quashing of FIR filed u/s 498 in the high court or your parents can also be discharged during police investigation or before judicial court at the time of framing charges. Similarly you can apply to DV court for discharging parents
