Hello, I have loan based upon my wife account and even on acceptation of wife. My wife withou knowing me, she use to message, calls and transfer money to another person without my knowledge. When i question she started saying as Brother. But i could not tolerate and accept this because that boys texted to her about our bedrooms matters, so i have applied for divorce on march 13 and marriage (arrange by Tamil Matrimony) done on march 9, 2017. I have proof of whatsapp shared message, photos by wearing nighty and bank statement - mobile recharge and money transfer to him. Now his advocate threats me that, he will file an case on me for fraud submission document for loan. Based upon Salary Account of my wife, i had taken. Also i have proof of OTP message forward to me (wife mobile to my mobile). Now she also saying that she did not know about it. Please sir, suggest me how to handle this. I am ready pre-closure the amount after 12 month as one time payment.

You dont worry about the warning given by your wife's Advocate. Your wife cannot file any case for fraud submission of documents for loan. You have not committed any fraud. Your wife has signed the loan papers willingly only. You have proof of everything that you are saying. So dont worry. If you need any further clarifications you can contact me. or

Sir,

As per the facts stated by you, you should file a police complaint to stop being harassed and to protect yourself from wrongful prosecution. If you have pre-closed the loan then there should not be any problem, if you are yet to pre-close it and then send a legal notice to your wife and the bank about your intention to settle the loan.

As regards to the alleged affair of your wife, file a police complaint against the man for adultery and cheating of money and proceed accordingly. You will have to act fast and time is of the essence.

Please get in touch with me for any further clarification.

I think you are scared. First of all the other lawyer has no business to talk to you or threaten you. So don't act on fear. You can work out your legal remedy and from your query, I noticed that you have filed a petition for divorce. You can take another miscellaneous application in the original petition and bring it to the notice of the court and seek some restraint order against your wife.
