Wife framing me for DV AND 125 in 2022.

We tied the knot in Oct 2019. Mere after a week I came to know about her narcissistic and toxic behaviour and she even left our matrimonial home. My mother and relatives somehow took her back after some days and she lived on and off with us for another 4 months (most of the time at her parent's). In March 2020 she left our home and started living with her parents. After our several unfruitful efforts of saving this toxic relationship, we (me and my wife) decided to part our ways by by mutual consent and in the month of December 2020 we filed the petion along with a MOU wherein it was clearly mentioned that we've settled all the dues and there is nothing to be claimed by either of us. At the time of statements (in March 2021), she said she wants to claim money. The case went to the mediation and a settlement was done. I paid a nominal sum and agrred to pay the rest of the amount at the time of 2nd motion. She never turned in for the 2nd motion post that even after sending her the notice

We would advise you to seek a detailed consultation for your complicated matrimonial issue. The terms of the MOU needs to be legally perused to enable you to tender our considered opinion. Do clarify as to status of DV And 125 Crpc case.

Your wife is in clear violation of the terms of settlement.
In which case you may file for a contempt. This, in the eyes of law is a grave offence.

If she’s not appearing on the date of second motion then you can always say to just ex parte her and do with the divorce. And since there was a MOU signed by both of you then you can also attach it in the order sheet. For more legal assistance I am just a call away.

Hi sir..!!!

You can file a contested divorce petition on the basis of cruelty if she is not turning up for 2nd motion. You don't have any other way. Mutual Divorce can only be done through consent and not by any other means.
If you want divorce you file a contested divorce. There is a possibility that when you file a contested divorce then she may come and request to revive the 2nd motion.

U seem have posted your concern many times ! It’s better u hire an expert advocate in this regard n follow his advice! Copy pasting here won’t give u much to understand ! If u Hv paid any amount file recovery within three years
