Wife filed RCR and Divorce case

17-May-2023 (In Divorce Law)
We are married for the last 15 months. My wife stayed with me only for only 5 months. She left matrimonial home for simple reasons i have proof that she left by her own. I sent legal notice to reunite and a police complaint to reunite but she filed RCR before RCR case starts she sent divorce case notice. I also wanted divorce but not interested to give maintenance or alimony as he is working earning 30 Thousand per month. Shall i acccept or deny her divorce case and try to come for mutual Divorce.

It is strange that your wife has filed both restitution of conjugal rights case and sent notice for divorce at the same time. This itself shows her self contradictory stand. If she had left the matrimonial home then she is not entitled to maintenance. You can get along with the divorce case. Mention about the divorce notice in the RCR case and willingness for divorce.

there is no acceptances or denial of divorce. it will be decided by the competent court. every male is having the issue of maintenance proceedings. first you have filled the rcr. if you are having real interest in reunion then proceed with the case or contest the case.
