Wife filed 498A section against me and family, 1st councelling attended and next councelling she has not come, FIR is pending. I am thinking to file a divorce petition since she is keeping quiet and I don't want to continue this relationship as she tortured my 2 years of life and my family. Please provide suggestion for the move?
if you want file divorce petition then you can file contested divorce petition against her in family court then court will send notice after receiveing .notice she will come to court later you can amicable resolve the problem in mediation by conducting counselling session

you can file a Divorce petition seeking divorce on the ground of cruelty and desertion the trial court after recording evidence accepted both the grounds and granted a decree of divorce in 498A case it's nothing will happen

Take a concious decision! First go for quashing of the FIR before high court if there are sufficient grounds and in addition to that you issue a legal notice calling upon her for divorce and file a divorce petition !
