Wife filed 498a, 406, DV after signing mutual consent divorce

06-Jul-2024 (In Divorce Law)
Me and my wife had a broken marriage since 2022. we got married in 2018 and since then no child came up even after asking her so many times she rejected as because she wants to enjoy life more. Now in 2024 i spoke to her about mutual consent divorce and we agreed to end it mutually. We signed the 13b petition stating everything is setttled and we want a mutual divorce. but after this petition filed, she got influenced by her mother and friends and filed a 498a ,406 against me and my family.

In my opinion, first of all you should go for bail before the Trial Court. Then approach High Court with a quash petition only for your family members first where you should take the ground of 13b mutual divorce that is already pending.

Hello, It's very difficult to opine in a matter like this without understanding the full situation, but you should immediately apply for Anticipatory Bail from the Court and then move forward with this issue. Regards
