Wife didnt accept two notices can i file for divorce and child custody

Maine wife ko 2 time notice bheja ghar vapis aane k liye..bt usne accept nahi kiya..woh hamesha 498 ki dhamki deti rahi..main ab divorce lena chahta hu..main divorce file kr skta hu kya..meri 2 year beti uske pas he ..lekin muze meri beti chahiye ..main kaise apni betiko pa saku?

Certainly u can file divorce under desersation and also ask court for child custody too.I case she is blackmailing with section 498A you can file an FIR by yourself saying she is giving mental torture and disturbing your family as well as professional life

Yes you can file divorce case in alternate to restitution of conjugal rights and also seek custody of child if she is unable to maintain the child, though as per relevant provisions of law till 5 years the custody of child shall be with wife. But in otherwise circumstances custody can be given to husband with permission to allow thw wife to meet children once in the week.

you can File a suit for restitution of conjugal right and pray for the custody of the child,
custody of child is always depend on the age of the child , and other factors need more details for proper response.
