Wife committed adultery and is apologetic they have a 7 year old kid

Having sexual intercourse voluntarily with someone else other than one’s spouse (Adultery) is a valid ground for divorce under the Hindu Marriage Act .

However only a man can be prosecuted for the offence of adultery under the IPC. An adulteress “wife” is absolutely free from criminal responsibility. A women cannot even be punished for “abetting” the offence. Adultery law, assumes that the “wife” was a hapless victim of adultery.

Court may ask the husband to give one chance to the husband. But even after that also he will not forgive his wife and not treat her like his wife . In that situation the court cannot do anything. It can ask husband to pay maintenance . They have a kid of 7 years threfore the wife will get sympathy from court.
