03-Jun-2023 (In Divorce Law)
Sir I am facing 498A divorce n maintenance. At the time of marriage they paid a dowry of 10 laks in the form of D.D. later i purchased a plot in the name of my plot with my earnings Family court drafted an MOU which contains 1.wife voluntarily agreed for relinqushment of alimony. 2. I have to pay 10 lakhs to two children. 3.either wife or children should not claim a share in self acquired or ancestral property. 4.must close all the cases and non of us should prosecute each other in any court or law. My question is 1. Can she claim for return of dowry amount after signing the MOU? 2. Can I claim the plot on my name after signing the MOU?

your MOU is a part of court record. In lieu of said MOU,the matter is settled. In terms of this MOU no one can violate the terms. If any one violates,it is a perjury i.e misleading the court. She cannot ask for return of money nor she can file any other type of litigation/case.Still you want more information, please contact me

Dear, After signing the MOU by both you and your wife, neither your wife could claim of return of dowry amount nor you could claim the plot on your name. Therefore, be careful before signing the MOU. If you are not ready to accept any of the terms of the MOU, inform the same to the court.
