Wife cheated multiple times. Want to apply for a mutual consnt divorce

06-Sep-2023 (In Divorce Law)
I am 36 with a 7 Y/O son. I used to observe my wife's unusual behavior and I happened to record her while she was speaking with someone on phone. I confronted and she agreed that she was being involved. This is time 2nd time I have caught her and now want to move on(the first time, I came across song recordings of her and some intimate messages saved in notes on her phone). Are these proofs valid? I am asking her for a mutual consent divorce. Will she have a right to ask for alimony?

Yes the messages if clearly indicating her indulgence in illicit relationship with other person then valid to prove her adulterous relationship. Even at this juncture she asks alimony for herself you don't have to give anything to her.

If you are going for mutual consent Divorce, you both have to decide amongst yourselves whether she wants alimony or no. Since it is mutual, you both have to agree for the terms and conditions. However, she should not ask for alimony since it is because of her that you both have decided to mutually get separated. For the complete process, you both can approach me

Mutual consent divorce is depend upon both parties understanding. If both parties are agreed for separation without disputing then it’s easy for mutual consent divorce. Depends your wife may ask for alimony.

you can apply for divorce on the ground of adultery as it is mentioned in all the loss related to marriage as a valid ground for divorce . Though adultery has been De criminalised by the Honourable Supreme Court it is still a valid ground for divorce in India . A woman who commits adultery is not liable for any kind of maintenance but it is on the either spouse to prove adultery . however there is a possibility that if she has no means of maintenance then the husband will have to provide for her till the charge of adultery is proved. moreover it is better for the spouses that t h e y get divorce mutually as it will be less time consuming and cost efficient . whatever terms there can be decided in the petition for mutually settlement of divorce

Mutual consent divorces allow the parties to decide whether one of them will have to pay alimony/maintenance. Either party might make alimony/maintenance payments, but only with the agreement of both parties. The couple agrees on the conditions of the divorce, and the court grants it. For any further assistance you can get in touch with me.
