Which city to file for Mutual Divorce

29-Jun-2023 (In Divorce Law)
My husband and I have decided to go for Mutual divorce. We’ve been married for 3 years and separated for about 10months. We were married in Delhi & resided in Bangalore. I want to know which of Delhi or Bangalore would be the right place to file for divorce for quick, hassle free and women-friendly process. We speak English & Hindi. What other factors to consider?

You may choose to file mutual divorce petition in either court. The only consideration for filing the petition should be convenience of both the parties. Being a practising Advocate in Delhi, I can say from personal experience that the courts here are quick and efficient. The judges here are sensitive and well-trained to handle matrimonial cases. Moreover Delhi has the advantage of the High Court and Supreme Court being here, if any direction is required from there in exercise of their supervisory jurisdiction.

If you both have already decided to go ahead with the mutual divorce then you can file it either in Delhi or Bangalore because your jurisdiction lies on both the places. And you both should also execute a settlement deed in which the terms and conditions can be mentioned for future reference. Documents required will be your marriage card, marriage photos, along with Aadhar Card & Passport size photographs of both of you. For more legal assistance I am just a call away.

The separation period needs to be at least 1 year. In that case it would take at least 6 months for it to ve finalised. However, if you need it to be even faster like in a month or so, it is advisable to show the separation period to be at least 1.5 years. The process in Delhi is much faster and hassle free. You may consult me in that regard.
