If your priority is certainty and avoiding prolonged monthly liability, an OTS can be better, but only if it is a properly recorded full-and-final settlement covering the wife’s claims there is no fixed duration for spousal maintenance, as it depends on the facts and court order. Child maintenance, however, needs separate consideration and cannot simply be waived by the wife.

hello, by the above message it seems you really want to save your job, if your wife knows about the place where you work she can give them written complaints against you but that won't be valid and of no use also if she has filed dv you will need to pay maintenance to the child and to the wife, so the best solution for you will be to settle it for once and for all, also to get out of this marriage and start a new life again, you office will not suspend you on the basis of your illness or any other personal complaint, if you work properly, you have to pay monthly maintanence till she gets married again or for the rest of your life if it is once granted, also got child it will be till the kid is of 18 years, but you can ask for custody if you are paying for the maintanence

There is no straight answer whether monthly is better or OTS. It really depends on your capacity to make payment and the quantum of the amount. If OTS is involved, its less cumbersome since you pay her once and its done. On the other hand, monthly wise payment gives you flexibility on payment and does not pinch your pocket at once. We can discuss about this depending on the facts and circumstances of your case and thereafter a proper guidance could be given.

Since you have already filed a contested divorce and a DV case is also pending, the issue of maintenance cannot be determined only on the basis of your salary or the duration of the marriage. The Court will consider the wife’s actual financial position, your income, liabilities, standard of living, existing DV proceedings/orders and other relevant circumstances. There is also no fixed period for which maintenance has to be paid. Depending on the facts and stage of proceedings, monthly maintenance or a mutually agreed one-time settlement may be considered. Regarding your concern about your office, a mere complaint or threat to approach your employer does not automatically mean that you will lose your job; however, the exact allegations and your employment/service conditions need to be examined carefully. For proper advice, please share the divorce petition, DV complaint/application, any maintenance order or notice, and relevant supporting documents on WhatsApp. After reviewing the documents, the appropriate strategy regarding maintenance, settlement/OTS and protection of your employment can be advised.

without details of your marriage life facts, financial, services details, wife financial condition, her parents financial it is not possible to give proper advice... you both filed cases against eachother so it is better to settle matter out of court though reletives or common friends... even though court meditation you can settle the case and amount, discuss your lawyer with your object...
