14-Oct-2023 (In Divorce Law)
My wife left our rented apartment where we were residing after a 498a complaint in nearest P.S. and took keys along with her I had filed for divorce. My items are locked in that flat what to do should I break the lock and empty the flat to avoid giving rent unnecessary or should I just pick my items only.

Very peculiar situation. Write a letter to your landlord informing that there is a dispute with wife and matter is in court. Wife has locked house and taken key with her. Also inform that now onwards you will not pay rent and he is free to take possession of his house in accordance with law.

If that rental flat is on your name you may make duplicate key and empty your flat as well as let the landlord know that you ending the rent agreement and clear all due. If you broke and enter the you might have to face some allegations in future.

I'm in similar scenario, wife filled 498a then changed the house key, locked it and left home. I kept her name on the property but am paying Emi.
