What to do if you find out your husband is already married? I discovered that my husband married ano

17-Jul-2024 (In Divorce Law)
We have been married for 10 years and have an eight-year-old daughter. At the time of our marriage, my husband had another woman's name on his passport, which he did not disclose. Years later, I discovered this, and he gave flimsy excuses. He does not have any divorce documents or proof of the other woman's death. I do not trust him. What to do if you find out your husband is already married? Can my marriage be considered illegal based on this? I want to end this marriage, but he is not willing to divorce me. Please suggest how I can proceed, as I also want sole custody of my child.

Marriage with another person while the earlier spouse is alive is an offence under IPC as well as a ground for divorce. Concealing the information of earlier marriage is also an offence under IPC. You can file a divorce petition as well as a criminal case agaist your husband.

Hi, Yes he can be charged for bigamy but you have to prove the relationship with another women as wife, as you have the sufficient proof that the name mentioned in the passport in the wife's coloumn is itself a sufficient proof of marriage unless he shows the death and divorce decree and you can also Make a Complaint before police authority for the fraud committed by your husband and you should file a divorce on that basis by showing the reason of cruelity and cheating and you should claim maintenance from him, and definitely you will get the custody of your child.
