Send a formal legal notice through an advocate (by registered post/acknowledgement due, courier and keep digital/WhatsApp receipts) stating facts, demanding that she return to the matrimonial home within a fixed time (commonly 15'30 days) and warning of legal steps if she does not; if there is no response you may file a petition for restitution of conjugal rights in the District/Family Court (Hindu Marriage Act, 1955 Section 9 or Special Marriage Act, 1954 Section 22) and the court will issue summons, hear defenses (reasonable excuse is on the wife) and may grant a decree of restitution -non'compliance with such a decree for one year can be relied on as a ground for divorce under Section 13(1A)(ii) of the Hindu Marriage Act; see Section 9 HMA text [https://indiankanoon.org/doc/322349/] and Section 22 SMA text [https://indiankanoon.org/doc/496766/]; leading authority upholding Section 9: Smt. Saroj Rani v. Sudarshan Kumar Chadha (Supreme Court, 1984) [https://indiankanoon.org/doc/1382895/] and supporting High Court discussion in Harvinder Kaur v. Harmander Singh Choudhry (Delhi HC) [https://indiankanoon.org/doc/191703/]; for divorce consequence see Section 13(1A)(ii) HMA [https://indiankanoon.org/doc/1284729/].

If a wife is not returning home, the husband has both legal and personal options to consider. Initially, open communication and mediation with the help of family elders or counselors can be attempted to understand and resolve the issues. If these efforts fail, the husband may file a petition for restitution of conjugal rights under Section 9 of the Hindu Marriage Act, requesting the court to direct the wife to resume marital life. However, if the wife still refuses to return despite a court order, the husband can use that as a legal ground for divorce. It's essential to approach the situation sensitively, considering both legal rights and emotional well-being.

If you want her to come back then kindly file a petition under section 9, Hindu marriage act (HMA) for restitution of conjugal rights. Sikhs are also covered under the Hindu marriage act. Therefore, you have your right under HMA. Therefore, when the court will order her to come back then she will have to.

You can file a petition of restitution of conjugal rights under section 9 of HMA ACT to bring her back. Court will issue a notice to her and she has to give a reason that why she is not willing to join your company. This is the only way possible to bring your wife back to your house.

Hello Sir, Plz file a case under section 9 of the Hindu marriage act. this section talks about the restitution of the conjugal rights. You will either get the company of your wife or a decree of divorce can be granted by the court, in case you wife refuses to join you without assigning any justifiable cause. regards Ankur
