What is the procedure for divorce and child custody ? Please advise.

I'm doing job in bank and get married in 2008 hv a 4yr child and want. Please guide me that how I proceed for divorce for quick settlement

For divorce you have to file a case under sec 13 in Hindu Marriage Act ; if your spouse is ready to give divorce than the same can be putted under 13 b - divorce by mutual consent . Else you have to take some other ground for getting the divorce .

If you want file divorce petition against husband/wife . divorce petition in court hindu marriage act 1955 of section 13 (b) is mutual consent both parties involved joint application give to court for divorce court given first date given 6month later than . Court asked to both parties they separate each other or live with tham . parties are said that we could not lived with than court granted divorce decree.

U can file divorce petition in session court under section 9 of Hindu marriage act..and if ur partner also want divorce then u take divorce with mutual concept ..and ur 4 years old children legaly leave with his mother.

As per ur quarry u r interested in mutual divorce u/s 13 HMA and require at least six month time from date of registered case in the court if booth spouse is agreed, and file case ,rest on VI's a vise

Daer friend as per your your query and according to law hindu marriage act section 13 B mutual consent with compromise file a divorce petition before family court and get divorce also custody of child without stellment you can't get quick divorce
