What is the minimum separation period for divorce in India?

29-May-2024 (In Divorce Law)
Is there a minimum separation period required before my wife can initiate divorce proceedings? In India, the minimum separation period before divorce depends on whether it's a contested divorce or a mutual consent divorce.

Mutual consent divorce requires the spouses to have been living separately for one year before filing (Section 13B(1), Hindu Marriage Act). Harveen Kaur (2017) held that the six'month cooling period is directory and may be waived in appropriate/exceptional cases. In India, the minimum separation period for divorce depends on the type of divorce and the grounds for filing.

  1. For a mutual divorce, where both husband and wife agree to divorce, the minimum period of separation required is one year. According to Section 13B of the Hindu Marriage Act, 1955, both parties must have been living separately for at least one year and must mutually agree to dissolve the marriage.
  2. For a contested divorce, where one party files for divorce and the other does not agree, the separation period depends on the reason for the divorce:
    • If the grounds for divorce are cruelty or adultery, there is no specific minimum separation period required.
    • If the reason is desertion, under Section 13(1)(b) of the Hindu Marriage Act, the spouse can file for divorce if the other spouse has deserted them for a continuous period of at least two years.
  3. Additional rule: According to Section 14 of the Hindu Marriage Act, 1955, the court may not entertain a divorce petition if it is filed within the first year of marriage, unless there are special circumstances such as exceptional hardship for the petitioner or serious misbehavior by the other spouse.

To file for a mutual divorce, it is important that both the husband and wife have been living separately for at least one year. Additionally, your marriage should have lasted for at least one year before you can file for divorce. However, in certain situations, you may be able to file for divorce earlier.

A divorce petition can generally be filed after one year of marriage. However, there is a provision in the law that allows it to be filed earlier if the party can show the court that there are extreme circumstances that justify an early divorce.

For a mutual divorce, the couple must be separated for at least one year. In a contested divorce based on desertion, the separation period should be at least three years. However, in a contested divorce based on cruelty, there is no specific separation period required.

Dear Client,

There is no specific minimum separation period required to file for divorce. In a contested divorce, the only condition is that you can file for divorce after one year of marriage. For a mutual divorce, both you and your wife can file after one year of separation.

In the case of mutual divorce, a 6-month separation is required. For the second motion, 6 to 18 months are typically needed. However, as per the decision made by the Hon'ble Supreme Court on September 12, 2017, divorce can be granted without the mandatory 18-month separation period. This is not a strict rule but rather a guideline, and it depends on the circumstances, such as if there is no possibility for the couple to live together.
