What is the court procedure in the case of maintenance
05-Oct-2023 (In Divorce Law)
I have filed a Maintenance case on my husband a few years back. The respondent got disappeared and did not attend to the court during the hearing. Finally, the respected court had sanctioned maintenance for me for which now the respondent had appeared to High court to set aside the petition. Can someone guide me in the process to win the case? Religion: Hindu

Since the court has granted an exparte maintenance order and that your husband has now appealed in the high court, you should contest his application in high court and get the same dismissed.
Generally a maintenance petition is always decreed in favour of the wife. Unless and until your husband has shown reasons such as your employment or other source of income,,courts will be inclined to grant you maintenance.
Another thing you need to take care is to ensure that your husband has not stated poverty, other dependents(his parents income/health etc) to reduce the maintenance awarded to you. So you need to engage a lawyer and challenge his petition at HIgh court.
