What Doesn't comes under Dowry

31-Mar-2023 (In Divorce Law)
My wife was once my GF . I took money from my Friends and paid her Credit Card bills. Post marriage she returned that money to me and I paid back to those people. Now I am going through Divorce and she had termed that Account transfer as Dowry , filing 498A case against me. This is the only allegation in her FIR . Please suggest will this come under Dowry ?

Hello any transaction between husband and wife can not be termed as dowry more over you may have record of payment of her credit card bills. Dowry can only be considered if money paid by your wife came from her parents and family although it need to be strongly proved by her. Complete details are needed to advice further.

Dear sir,

As per the law, the return of funds do not constitute dowry. As long as you can demonstrate that this was the repayment of a debt as opposed to a demanded dowry, this would not come under the same.

If you are facing difficulty in this matter, we would be happy to help you.
