What does an ex-parte judgement mean.

kindly confirm that my sister filed the case for maintenance in Dwarka Court but the husband not presented in the court now he has declared x party by the judge, what does it mean and what would be the next step of the court. 2 year back case was in CAW cell and my sister start living with her husband but the same things were started again beating and abusing. Now if we file 498a than entire procedure of CAW Cell will be repeat or directly charge sheet will submit in the court.

Ex parte means now court will decide the case of your sister without hearing her husband and guve their judgement on sole basis of your sisters evidence. Their claim may be passed as she presented before

Declared ex-parte means that husband has since failed to appear the case will proceed without his defense and order will be passed in favor of wife for maintenance case . She can file fresh FIR and or dv case.

If the husband has been declared as ex Partie then the court will proceed against ex partie evidence there on he will be declared PO and also criminal proceedings u/s 82 will begin .Further his property can be attached and if he represents himself in court he can be retained in civil imprisonment as well in execution of decree what are the proceedings we talking about in which he has been declared as ex partie??please clarify thanks.
