What all proofs required to form the ground of the divorce

I am hindu,37 year old male. we have 2 kids , boys 6 & 8 year old. my wife moved to in-laws place last year & from last 8 months she is having an affair with another guy, I heard their phone conversation & recorded couple of conversation which proves that she is having an affair. I would like to apply for divorce based on cheating & take the custody of one kid. Please suggest what all other proof i can collect before applying for divorce.

You can file the divorce before the competent court on the proper grounds, if you have the conversation records and other information, you can use the same during tne trial. You can claim for the child custody.

Dear sir,
For obtaining decree of divorce, you can file a case before Family court for the same relief on adultery ground, before making allegations you have to secure witness to prove the same, if you don't have sufficient proof it is better to file a case under cruality ground.

Whatever you have a proof, you can get and consult for divorce and other monetary relief etc., you need to explain more and file a appropriate suit seeking divorce . You need to get wedding card , address proof et., consult.

As stated by you the evidence is enough proof provided it must with stand the cross examination of other side. You cannot presume what sort of defense your wife is having. Better sort out the misunderstandings and try for mutual divorce which is very easy and instant, other wise you have to under go mental torture for years together in the given set of laws.

Dear friend,
You can come and meet the relevant documents that you have till now or what you think is important for your case and with marriage certificate or marriage photos of both at times of marriage , wedding card , etc and meet at earliest to help you earlier. Ofc : Adv pankaj Kumar & associate....
