we separated from last 2 years i want to take legal separation


17-Feb-2024 (In Divorce Law)
in 2016 March we got married in 2016 December my son was born, and married the next day, I found his affair but he made a lot of promises and he convinced me and I gave chance but after that also he was in another affair with last 8 years. every time he made promises and he convinced me bcoz of a baby I forgave, he maintained more than 8 relationships am tired of this i want to separate from him I don't want any money from him I need my baby please Tell me the process from 2022 we separated

if you have Devudu separately from him from 2022 that itself will make you eligible to file file for Divorce. but this will net be a sufficient ground for you to get divorce from court. are you having any proof of his multiple affairs ? weather he is not providing sufficiently for either you or child ? who went away from home in 2022 ? you are him ? whether he will agree for a mutual consent divorce ?

You can both file for mutual consent petition where you can mention that there is no claim for maintenance. The case can be filed and closed within a month’s time in Bangalore. If he does not agree for mutual consent then you can file a contested petition and when the case is posted for mediation you can close the case through an amicable settlement (divorce without alimony) and that you will have custody of the child.
