We have been married for 3-4 months only. My wife is asking me to get separated from patents. She has left home and went to her parents house . She is continuously threatening me for divorce and police complaints using women's right. I have following queries : 1. If I want divorce what are the ways and process for it. 2. Should I take any action beforehand as a precaution or should I wait . 3. After how long will we be eligible for divorce.

As per Hindu Marriage Act the divorce can be sought after a lapse of 1 year from the date of marriage only. In case your wife is threatening for false litigation, you should take a precautionary message and file an appropriate application with the concerned authorities plus other legal remedies.

It is correct that women have their rights. However, in the name of rights false complaints are not allowed. If you are not at fault and someone is threatening you then you may be required to take necessary legal action to save yourself. You may meet us in person and discuss your issues in detail to understand future course of action. Brij Mohan (Adv.)
