want to void marriage... because marriage done by fraud

after one day of marriage my wife left house because I asked the truth about her age... because before marriage she told me that she is 2 years younger than me....but after one day of marriage I found she is 3 year older than me....we never live together...its been 2 years so now I want to appeal before court for Void this marriage....Can I appeal?

If the consent of one of the parties in the marriage was procured on the basis of coercion or fraud or force, a marriage can be declared null and void. you can file a case for declaration of the marriage as null and void in appropriate Court should you have any questions please feel free to contact me.

If the behaviour of your partner is intolerable towards you can anytime send a complaint regarding your grievances in writing to the police station according to your jurisdiction. And if you wish to go legal and if there's no scope of living together then rather stretching the relationship you should file for contested divorce under the ground of cruelty. I would suggest you to go with mutual divorce because it's cost effective and ends up in a maximum of six months.

If non-disclosure of age amounts to cruelty then certainly divorce can be granted. Here you have to convince the Court that although such an age difference might be a trivial issue but in your mind, the idea of a happy marriage was subject to compatibility of age.

if she is major so you can not file the case of void because it is not a ground to void marriage. if any other reason like if she is dipression patient or she hide education on this ground you can file the case of void

You don’t appeal at the first instance. first you shall file a case seeking divorce and nullity clubbed together stating therein whatever circumstances had arisen at whatever stage. You shall be granted divorce on pretext of cruelty and desertion
