Want to Meet My Daughter in wifes custody

My daughter is 1 year old and i haven't seen her from last 8 months. my child interim custody case is in family court it just getting dates. Visitation rights also taking time. At this tender age my daughter will not even recognize me. My wife does not allow me to see her. Can i get any help from children cell or any other organization to atleast see my daughter as its my and my daughters fundamental right. My wife also does not let me send her gifts on occasions and return them when i deliver them by online shipping. Should i complain somewhere about this. I really want to see my daughter. She has filed DV case against me also. thats in proceeding.s

Sir if your wife has filed case under DV act then you can immediately move an application For Visitation right or custody of the child under section 21 Of the act. For your convenient I Have reproduce the section 21 of the act custody orders.—Notwithstanding anything contained in any other law for the time being in force, the Magistrate may, at any stage of hearing of the a Interim pplication for protection order or for any other relief under this Act grant temporary custody of any child or children to the aggrieved person or the person making an application on her behalf and specify, if necessary, the arrangements for visit of such child or children by the respondent: Provided that if the Magistrate is of the opinion that any visit of the respondent may be harmful to the interests of the child or children, the Magistrate shall refuse to allow such visit.

Hi yes you can file case regarding this issue for more detail you can contact me through LawRato you have legal right to see your child if your case is pending for adjudication even after order for child custody
