Want to go abroad without divorce

02-Jan-2023 (In Divorce Law)
Hi I am a woman who has been married for more than 2 years. My in laws and husband have been treating me badly and I hv gone thru a lot which forced me to move out of my house. This has happened before as well but they dont give a damm and now I dont want to give him divorce. recently separated from my husband in the month of September. I want to apply for higher studies abroad. Is there a possibility that I cant appoint a lawyer on my behalf and go without informing him. Or can he file a case against me.

In this regard, i advice you that you can certainly file DV petition thereby bringing your in laws and husband in court of law and seek maintenance nd other protection order. Your presence may be required for few initial dates as DIR report has to be made on the basis of which Protection orders are passed. You need to take permission from the Court for higher studies and that can certainly be allowed by the Court. independent career is your prerogative and courts cannot prevent you from taking you career. There is method and strategy to pursue your claims in court and you will succeed. For further clarification on the issue, please contact.

you can do that but its a tricky situation. the wife is supposed to live with the husband in the matrimonial house and has a duty towards the same. you can obviously go out for higher studies without informing him but it can be taken against you in court. however, you do have certain rights which you can exercise.
