Want to file divorce and get full custody of daughter

I want to file for divorce (Christian wedding) due to physical abuse and living separately with 13 yr old daughter for last 4.5 yrs. I want to get full custody of my daughter, no contacts with my husband for the last 4.5 yrs. What would be the procedure? Will I be able to claim maintenance for my daughter as my husband is not working? I was the one working and running the family since the time of marriage.

You can apply for divorce under Indian Divorce Act as we ll child custody and maintenance for child. If he is not earning but he is duty bound to maintain the child if wife is working and educated enough to earn money.

You can file a case against your husband in family court for sole custody of your daughter for yourself. you can also playing maintenance for the daughter , to claim sole Custody you must have proper grounds.
