Want to file a divorce because I am not happy with my marriage

08-Oct-2025 (In Divorce Law)
I am married for 2 and half years now. I want to file a divorce because I am not happy in my marriage. I don’t want to ruin the opposite persons reputation or make them bad… I just don’t think I can fit in that house and I don’t want to stay there and waste everyones time and life. I just want to Stay happy by myself alone. I regret marrying soo Is that possible?? Note: It might not be easy to get rid of the other person. Mutual consent is not an option soo any other way!??

You can file for divorce even without mutual consent by approaching the Court under Section 13 of the Hindu Marriage Act, 1955 (or respective personal law). Since you mentioned that you are unhappy and cannot adjust, mutual consent is not the only option. You can file a contested divorce by proving legally recognised grounds such as cruelty (mental or physical), desertion, incompatibility leading to mental agony, or any other valid ground. The Court will issue notice to the other party and proceed with trial. If the opposite side does not contest strongly, decree of divorce can be granted. Mutual consent not compulsory. You may proceed with contested divorce petition citing valid grounds. The court will decide based on your evidence and circumstances. This way, you can legally end the marriage and move forward with your independent life.

I appreciate that you wish to end the marriage without blaming your partner. Yes, you can still go for a contested divorce with proper legal grounds like cruelty or incompatibility. It may take time but allows you to move forward peacefully and lawfully.
