Want advise to divorce deserted Russian wife

Hello, I was married to a Russian woman in the year 2008. She left to Russia in the year 2013 and out of reach or any contact for the past 3 years. As she deserted me for years, she is unavailable for any discussion or response for a mutual consent divorce. My query is: I would like to file a Divorce on the ground of desertion. How long does the divorce procedure will take? Or is there any other ground for me to file in order to simplify Divorce procedure. Please advise. Thanks

Hello,

You can file a divorce on the ground of cruelty and desertion.

If your wife does not appear before the court to defend the case, she will be set exparte and the case will be decided he her absence.

If you can make out a clear case of cruelty and desertion, then we should be able to complete the process in 6 months.

You have not mentioned where the marriage got solemnized and where both of you resided before desertion.The legal recourse is to file a divorce petition before court of competent jurisdiction.However, it is your responsibility to provide her address and a mere plea of vanishing may not help in the court of law.

You have not stated about the marriage either under Hindu religious or Christianity.
Any have you can file petition for divorce on the ground of desertion.
Please save and collect proofs in regarding the steps taken to find out her
It will take 3 months to 1 year to get solutions from court.

You have not given details about where you got married and where both of you resided lastly. The jurisdiction can be decided only on the above said facts. Time limit cannot be decided right now since she is residing in Russia. We will have to undergo lots of formalities for serving notice on her. Finally publication in News Paper in Russia will be ordered. You can get divorce only after all these formalities.

You can file a petition for divorce on the grounds of desertion and cruelty. The procedure will take about 6 months. She she will not be appearing in Court, we can get the divorce at the earliest. If you are in Chennai you can contact me for further advice and assistance.
