Want a divorce from my husband and custody of daughter

My husband torture me. Mentally physically. He didn't work properly. So we are weak financially. No respect in house. He is heart patient. Because he drinks and smoke..and unhealthy life style. I don't want to live with my daughter in this type of environment. Bahut Shaq karte hain.. after 10 years I started talked a person. And now he is blaming all me and that person for unhappy marriage. 13 years of marriage he use violence, abuse in front of everyone. His mother also use violence against me.

the wife can file a case for maintence and also a case under the domestic violence act under 498a domestic violence means the continuity of acts and not by the number of years of marriage. you can file a case for mental and physical harassment
