Unable to file ws in 125crpc case till now. The case started on 05 Jun

I failed to file my ws . Plz tell me the time limit of filing ws in 125 crpc case and what can I do to file my ws any application or any remady.

Hi, It needs to be filed within a period granted by the concerned Family Court. Since the provisions if CPC does not apply to 125 petition so there is no prescribed period for filing reply. However, Supreme Court has held that defense can be strike off in case of willful disobedience of the order

Normally the time limit for filing of WS is 30-90 days. But you can always file it beyond the given stimulated time by attaching an application for condonation of delay under section 5 limitation act and writing down your excuse as to why you are unable to file your WS on time.

Usually 90 days are prescribed under the Code of Civil Procedure for filing a Written Statement to the suit or a petition. However, it can be filed later on alongwith the condonation application stating the reason for delay. For further advise you may connect

If your limitation period has expired for filing your written statement, you need to file an application for condonation of delay explaining reasons for delay of each day. If your application is allowed you may be allowed to file your WS. You may consult me in that regard.

You can file your WS within 90 days from receipt of acknowledgment and if that time has lapsed then you need to show the valid reasons for the condonation of delay. You need to hire expert advocate in this matter Plz b in touch
