UK citizen now but Indian when married in India.
20-May-2023 (In Divorce Law)
Hi,
We both are UK citizen now, but were Indian citizen at the time of marriage. We have been married for nearly 10 years and have a 4 year old kid, with one flat in the UK as joint ownership for which he pays the home loan. I left job due one persons salary going into childcare expenses. We do not share same interests, and argue everyday if and when we talk. Mostly we do not talk to each other living under the same roof. I get monthly money from my family to help me with my cost of living, Husband only pays home loans and some utility bills, I share some Utility bills despite of not working.
What are my options to file for a divorce ? what are the steps? What happens to to our Flat? How do I start a divorce proceedings ? I really need some help and insight please!!
since marriage has been solemnized in India you can file case in India for mutual divorce and both of you can seek divorce as per the law applicable to you in mutual divorce husband and wife have to amicably settle the matter and arrive at a settlement that Court can pass decree of divorce with consent of both parties
hello, whereas you are an UK citizen, so you can file your divorce suit there, in Indian jurisdiction divorce suit can be filed where marriage is solemnised. Also if you file here in India the summon should be proceed through ministry of external affairs. So kindly talk to Indian embassy before taking any decision. Through power of attorney you can proceed here too, but depending on Court's decision. For any further enquiry kindly feel free to call.
