To know possibility of creating issues after divorce

15-Jun-2023 (In Divorce Law)
After the mutual divorce, wherein the custody of a girl child mutually agreed with the mother by both parties: (A) Whether the ex-husband can create nuisances to the lady in her next marriage? (B) Can he disturb the new family or his ex-wife on account of being a biological father? What are the measures she can take to reduce this? (C) Though it is mentioned, time and place for meeting with the child in the initial application for divorce but in case of shifting state or country – whether he can create some issues? All parties are from the Hinduism religion.

In response to query (A) Ex-Husband in no manner create problems with the wife’s new marriage, if he does so, you can immediately file a police complaint against him. (B) He can not disturb the new family on any account, once there are timings and place of meeting already decided, there shouldn’t be any default in that, as meeting his child is his right. Still if there is a default from mother’s end in getting the child to meet her father, then also the father can not harass the family in any way, he has to approach the court for that. (C) if the mother is relocating, she may approach the court with the application for relocation and also send the same to the father. For further details please connect.

Hello, these are very valid questions one will have before entering into a second marriage. I will answer your question one by one, first of all the Ex husband can not create nuisance in the life of his ex wife. Secondly, he cannot disturb the family but he will can the matter in Court to say that the circumstances has changed and ask the Court to look over the Custody matter again. Lastly he can object to such shifting and the other party will be liable for contempt of Court. So before moving the child to any other place or country you will need the NOC of the Biological Father.
