Timeframe for applying for mutual Divorce

Can husband file a mutual Divorce case only on the basis of 2 years separation?nIf wife wants reconciliation bt husband and his parents are not allowing for entry into home and even not ready for any family discussion, in this case will counseling be done in the court for reconciliation as wife is not agreeing for divorce.or directly husband will be given decree of divorce based on 2 yrs separation

2 Years Separation cannot be your Only Grounds for Divorce. You will have to prove other Valid Grounds for Divorce as well. Decree of Divorce will not be granted directly. Your Wife will also be called upon and given the Opportunity to present her side of the Case. Mutual Divorce is when Both Husband and Wife want Divorce unlike your present Case. So you’ll have to file a Divorce Petition on Grounds of Merit to prove your Case.

husband cannot approach court asking for mutual Divorce but husband has the right to file contested divorce on the grounds of desertion provided his wife has left him and they r leaving separately for more than 2 years without any conjugal relations or husband can approach court on the grounds of cruelty.

Well, as a Wife, you should apply for Restitution of Conjugal Rights, i.e, an Application for Restoration of Sexual Activities between you and your Spouse and as such for the restoration of other duties a Married Man is entitled to perform towards you
