Time line for a Divorce case to conclude

I have filled Case with Court on Alimoney post sending a formal notice of alimoney to him. Pls suggest a way-out if he doesn't response to Alimoney. I want to move forward with my 2.5 year old baby without using his name. Pls Advice & how much time it will take, I want Divorse but would like to get it from other side.

Dear Madam/Sir;
if you have at dessertion period, then u may file divorce petition under Hindu marriage act,icluding ground as cruelty i.e. under section 498, and morever, if you had been send a notice for alimoney or he can not replied to said notice then you also file case for restitution of conjugal rights(if you want); in that case he will not responcing the same the you have meet one more ground for Divorce, the you will seek divorce essily.

To reply to your query I need more clarity you have filed for Alimony?? or maintenance under Domestic Violence Act as towards the end you have written that you want Divorce but would like to get it from him. Timeline of matters in Court cannot be predicted but approximatly Around 18 to 24 months if contested. You can contact me for a detailed explanation.

Alimony depends on status of both parties. If you are unable to maintain yourself then you are liable to get alimony from your husband source of income. Of divorce is filed from one side , it will take more one and half year to get divorce.
