Questions Answered by Advocate Vishwajit Yeshwant Pawar

Q: How many days is a police complaint valid after a legal notice in criminal cases, and after how many

What is the time limit to file a criminal case after sending a legal notice in criminal cases, and how many days is a police complaint valid?

Advocate Vishwajit Yeshwant Pawar answered
Generally, when we issue a legal notice, we specify a period of 15 days for the recipient to respond. If no response is received, the cause of action begins from the date the recipient receives the notice. Different periods of limitation are prescribed under the Indian Limitation Act based on the nature of the case. For example, to file a complaint under Section 138 of the Negotiable Instruments Act, a period of one month is prescribed from the date of receipt of the notice. If you need further assistance regarding how to get complaint copy from police station, feel free to contact me.
