Threatening to file a false dowry case

My brother has been threatened by her wife since last 2-3 years ...
She is not agree to take divorce as well as she is not well with her.. Wht should he do to leave her without any court cases...
your brother should send a legal notice to his wife for come and live with him. in this notice it should be clearly mentioned that his wife is not living without any sufficient cause or valid reason. If she don't reply to this notice or replied with negative answer then your brother can file a petition against his wife for restitution of conjugal right under section 9 of hindu marriage act before the family court. These notice and petition will be very helpful and benificial in case which can be file by his wife against him. in restitution of conjugal right case the court will send matter for mediation where your brother and his wife can settle all the things. if they agree to live together otherwise they can file petition for divorce on mutual consent basis.
