If the wife snatches the child from you and the child has been living with you comfortably then you can approach the Court. However, at this point in time if the child is with you and the mother is visiting the child then let her meet the child. Feel free to contact me for seeking any legal advice as regards the same.

Well, the Husband can apply to seek Permanent Custody of the Child, by doing this, he will be able to admit him in whichever school he wants, being a natural guardian of the child, however to get the permanent Custody, Husband has to prove that Wife cannot take welfare of the child in an efficient way and she does not have requisite financial means to do so!

Dear client based on your query, since the child is only 5years old courts may generally prioritize the childs welfare over parental preference. However if the husband fears that the wife might take the child without mutual consent. The husband can approach the family court. For further legal guidance feel free to contact us.
